Pension legal services overview

Three services, clearly defined

Each service has a purpose, a scope, and a fee — stated plainly before you commit.

Lentera Pencen does not offer a general legal retainer. We offer three services: a first consultation, a formal appeal, and family settlement documents — each designed to do one thing well.

Our Methodology

How we approach each matter

Every engagement at Lentera Pencen begins with a clear understanding of scope. Before any service is engaged, the advising lawyer explains what the service covers, what it does not cover, what the fee is, and what the client should expect at each stage.

We do not use standard letter templates for substantive correspondence. Each letter to a pension authority or employer is drafted to the particular facts of the file. We believe this produces better outcomes and a clearer record, if escalation later becomes necessary.

Quality assurance is embedded in the process: every document prepared for signature is reviewed by a second lawyer before it is presented to the client. This applies to wills, EPF nominations, and hibah instruments alike.

Service 01

Quiet Consultation on Pension Matters

A single, unhurried meeting for clients who simply want to talk through a pension concern with a lawyer before deciding whether anything further is needed. The session covers the client's own circumstances, relevant Malaysian pension provisions, and a candid view on whether the matter is best resolved in writing, through KWSP processes, or through a more formal route. There is no fee for time the client decides not to use, and the firm gladly explains all options without pressing for an engagement.

  • One-to-one session with a qualified pension lawyer
  • Review of relevant KWSP and government pension provisions
  • Candid assessment of options without obligation
  • Written meeting summary provided afterwards
  • Family members may attend

Process

You contact us briefly describing your concern.
We identify the relevant legal framework in advance.
We meet at the office for an unhurried discussion.
We send a written summary within two working days.
Quiet consultation session

A candid note on scope

This session is advisory in nature. It does not include formal legal correspondence on your behalf or document preparation. Those services are available separately if the consultation suggests they would be useful.

Pension appeal correspondence

A candid note on scope

An appeal can correct errors in calculation. It cannot override a decision made within a body's lawful discretion. We will assess this distinction at the consultation stage and explain it plainly before you commit to the service.

Service 02

Pension Reduction Appeal

Considered representation for retirees whose pension has been reduced, suspended, or recalculated without sufficient explanation. The firm corresponds with the responsible employer or pension authority, requests the underlying calculation, and where errors are identified, pursues a written correction. Time and cost are discussed candidly at the outset; the client is never asked to commit to further work without a clear sense of what it involves.

  • Review of pension reduction notice and calculation basis
  • Formal written request for underlying computation
  • Identification of errors or procedural omissions
  • Formal appeal correspondence with the responsible authority
  • Progress updates at each stage of the process

Process

Initial consultation to assess the viability of an appeal.
Formal request for the underlying pension calculation.
Review for errors; preparation of appeal letter.
Submission and follow-up; outcome communicated in writing.

Service 03

Family Pension Settlement Drafting

A careful drafting service for clients who wish to formalize how their pension and retirement assets will be received and used by family members after their lifetime. The firm prepares the necessary documents — wills, EPF nominations, hibah letters where appropriate — and reviews them in a relaxed sitting with the client. Where family members are present, the discussion is allowed to take its own time; nothing is hurried to a signature.

  • Will drafting tailored to retirement asset distribution
  • EPF nomination review and preparation
  • Hibah letter drafting where applicable under Islamic law
  • Relaxed review sitting — no pressure toward a signature
  • Documents prepared in English or Bahasa Malaysia

Process

First meeting to understand assets, family structure, and intentions.
Identification of appropriate instruments (will, nomination, hibah).
Drafting and internal review by second lawyer.
Review sitting with client (and family, if attending). Signing when ready.
Family settlement documents

A candid note on scope

This service addresses how pension and EPF assets are documented for family distribution. It does not constitute full estate planning. Where broader estate matters arise, we can refer you to appropriate counsel.
