These Terms and Conditions ("Terms") govern the use of the website at lenteraped and the engagement of legal services provided by Lentera Pencen, a legal practice registered in Malaysia, with its principal office at No. 47, Jalan Wong Ah Fook, 80000 Johor Bahru, Johor ("we", "us", "the firm").
By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or engage our services.
1. Definitions
- "Service" — any legal service provided by Lentera Pencen, including consultation, appeal representation, and document drafting
- "Client" — any individual who has formally engaged a service from the firm
- "Enquirer" — any person who contacts the firm without yet having engaged a formal service
- "Agreement" — the combination of these Terms and any engagement letter or service confirmation sent to the Client
- "Matter" — the specific legal concern that is the subject of the engagement
2. Acceptance of Terms
Use of this website constitutes acceptance of these Terms. A formal client relationship is established only upon the firm's written confirmation of an engagement, not upon submission of a contact form or website enquiry. Clients must be aged 18 or over and have legal capacity to enter into an agreement under Malaysian law.
3. Service Description
Lentera Pencen provides three legal services relating to pension and retirement asset matters in Malaysia:
- Quiet Consultation on Pension Matters (RM 330)
- Pension Reduction Appeal (RM 700)
- Family Pension Settlement Drafting (RM 940)
The scope of each service is described in the firm's published service descriptions and, upon engagement, in the engagement letter provided to the Client. Services are available to clients located in Malaysia. Where a client is located outside Malaysia, availability is at the firm's discretion.
4. Client Responsibilities
Clients are responsible for:
- Providing accurate and complete information relevant to their matter
- Responding to the firm's reasonable requests for documents or information in a timely manner
- Informing the firm promptly of any changes in circumstances that may affect the matter
- Keeping the firm informed of any direct communications with pension authorities or third parties related to the matter
The firm's ability to act on a matter may be affected by the Client's failure to fulfil these responsibilities, and the firm accepts no liability for adverse outcomes arising from incomplete or inaccurate information provided by the Client.
5. Acceptable Use of Website
You may use this website for lawful purposes only. You must not:
- Attempt to gain unauthorised access to any part of the website or its systems
- Use the website to transmit unsolicited communications
- Submit false or misleading information through any form on the website
- Use the website in any manner that could damage its functionality or reputation
6. Intellectual Property
All content on this website — including text, design, and structure — is the property of Lentera Pencen or is used with permission. You may not reproduce, distribute, or adapt any part of this website without our prior written consent. Legal documents prepared by the firm for a Client are the property of the Client upon full payment of the applicable fee.
7. Payment Terms
7.1 Fees
Fees for each service are published on the firm's website. All fees are denominated in Malaysian Ringgit (RM). Fees are payable prior to the commencement of the service, unless otherwise agreed in writing.
7.2 Consultation Fee
The consultation fee (RM 330) covers a full session. Where a client uses a shorter portion of the allocated time, the fee is adjusted proportionally to the time actually used.
7.3 Scope Changes
Where the scope of a matter extends materially beyond what was anticipated at engagement, the firm will discuss any additional fee with the Client before proceeding. No additional charges will be incurred without the Client's written agreement.
7.4 Methods of Payment
Accepted payment methods include bank transfer, online transfer, and cash at the office. Cheques are accepted by prior arrangement.
8. Service-Specific Terms
8.1 Consultation
A consultation provides legal information and a candid assessment of options. It does not constitute formal legal representation and does not create an obligation on either party to proceed with further engagement.
8.2 Pension Reduction Appeal
The firm will assess the viability of an appeal before the Client commits to the service. The firm does not make commitments about outcomes, which depend on the response of the relevant authority. The appeal service covers correspondence and formal submission; it does not include litigation or tribunal proceedings unless separately agreed.
8.3 Settlement Drafting
Documents prepared under this service are reviewed by a second lawyer before presentation to the Client. The Client should not sign any document until they are fully satisfied with its contents. The firm will allow the review sitting to take whatever time it requires.
9. Disclaimers
Legal advice provided by the firm reflects the law as it stands at the time of advice. The firm is not responsible for changes in legislation that occur after advice has been given. The content on this website is for general information only and does not constitute legal advice. No solicitor-client relationship is formed by reading or using this website.
The firm does not make representations about specific outcomes. Every pension matter is subject to the decisions of third parties — pension authorities, employers, and courts — over whom the firm has no control.
10. Limitation of Liability
To the extent permitted by Malaysian law, the firm's liability for any claim arising from the provision of services is limited to the fee paid for the relevant service. The firm is not liable for indirect, consequential, or special damages arising from a matter's outcome.
Nothing in these Terms limits liability for fraud, gross negligence, or any other liability that cannot lawfully be excluded.
11. Termination
Either party may terminate an engagement with reasonable notice in writing. The firm may terminate an engagement where the Client has not provided information necessary to proceed, has acted in breach of these Terms, or where continuation would create a conflict of interest. Fees for work completed prior to termination remain payable.
12. Dispute Resolution
In the event of a dispute arising from these Terms or an engagement, the parties agree to first attempt informal resolution by contacting the firm's principal directly. If the matter is not resolved within thirty days, either party may refer the dispute to mediation under the rules of the Malaysian Mediation Centre before commencing formal proceedings. These Terms are governed by the laws of Malaysia, and the courts of Johor Bahru shall have exclusive jurisdiction.
13. General Provisions
- Entire Agreement — These Terms, together with any engagement letter, constitute the entire agreement between the parties in relation to the relevant service.
- Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver — A failure to enforce any provision of these Terms does not constitute a waiver of the right to enforce it in future.
- Assignment — The Client may not assign their rights under these Terms without the firm's prior written consent.
14. Changes to Terms
These Terms may be updated periodically. The effective date at the top of this page reflects the most recent revision. Continued use of the website or services after a revision constitutes acceptance of the updated Terms.
